There are several factors that determine whether a person is eligible for spousal support.

The spouse seeking spousal support must be unable to earn enough income to support their minimum reasonable needs. A disability can stop a person from working. If the spouse is caring for a child who requires a lot of care because they have a physical or mental disability, then they may be able to get spousal support or lifelong child support. Additionally, if the marriage lasted for 10 years or more, then the person may be eligible for spousal support.

Keep in mind that just because someone is eligible for spousal support, it does not mean that you will automatically get it. The employment history of both spouses, infidelity, the contributions of the homemaker and the duration of the marriage will be taken into consideration.

How Long Does Support Last? 

The length of the marriage will determine how long one will be paid child support. If the marriage lasted less than 10 years, then a person can receive support for five years. They can also get support for up to 5 years if the marriage lasted between 10 and 20 years. One can receive support for up to 7 years if the marriage lasted between 20 and 30 years. Additionally, people can receive support for up to 10 years if the marriage lasted for 30 years or longer.

How Much Will I Have to Pay? 

The court will decide how much the person will have to pay. However, the amount will be based on a percentage of the paying spouses’ Income.
